NEW YORK STATE AND NEW YORK CITY SEXUAL HARASSMENT TRAINING MANDATES: TIME RUNNING OUT FOR NEW YORK EMPLOYERS

Employers have only another month to ensure legal compliance with the recently enacted New York State laws mandating sexual harassment training for employers of any size. Although the law was enacted October 9, 2018, it provided employers with up until October 9, 2019 to provide the initial training and then it must be provided annually thereafter to all full-time and part-time employees, seasonal employees and temporary employees. The training the employer provides must meet or exceed the requirements of the law which provide that the training must be “interactive”. The regulations provide that having employees watch a sexual harassment training video or reading your policy would clearly not be enough to ensure compliance with the law. In addition to being interactive, the training must also provide an explanation of sexual harassment that is consistent with the Department of Labor guidance and include specific examples of conduct that would constitute unlawful sexual harassment. The training also needs to provide employees with remedies available to victims of sexual harassment under both federal, state and local law and include information for employees to rights of redress and what forums are available for adjudicating sexual harassment complaints. The training must also educate all employees on the heightened responsibilities that supervisors/managers have for preventing harassment in the workplace.
