Legal Pitfalls When Hiring Candidates

So much of HR's responsibilities relate to hiring. The employment laws have gotten so complicated now, that HR must really be on top of their game to best understand what they can and cannot do when hiring candidates.  What legal issues face you when interviewing candidates regarding pre-employment inquiries. What can you lawfully ask a candidate and what questions should you avoid at all costs. New laws are being passed constantly such as the recently-enacted state laws prohibiting an employer from asking about past salary history.  Should you show the applicant the job description during the interview and what should the job description contain. Do you need to know FLSA issues such as whether the position for which you are hiring is exempt or non-exempt before you interview the candidate. You must be aware of other legal issues such as should you conduct a background check and if you do how do you comply with the requirements of the Fair Credit Reporting Act ("FCRA"). What can you put in an offer letter and what should you avoid. Then, once the employee is hired you need to understand how to complete the I-9 and the legal pitfalls when you fail to complete is correctly. GINA enforcement is now on the EEOC's radar so HR must understand what legal requirements there are when conducting pre-employment physicals.
