The legal landscape has shifted significantly. While pregnancy itself was not traditionally considered a disability under the ADA, the Pregnant Workers Fairness Act now affirmatively require employers to provide reasonable accommodations to pregnant women. Additionally, federal guidance and a multitude of state and local laws now require employers to provide reasonable accommodations to pregnant employees.
Recent developments have made compliance more complex—and more critical than ever. The U.S. Equal Employment Opportunity Commission has issued updated guidance indicating that pregnancy-related conditions may require reasonable accommodations. At the same time, the Supreme Court of the United States clarified employer obligations under the Pregnancy Discrimination Act in Young v. United Parcel Service, Inc.. The Court held that policies placing a “significant burden” on pregnant employees may violate the law—particularly if accommodations are provided to other employees with similar limitations.
